King @ Law will take the lead in your simple, uncontested divorce. Attorney David King will prepare and file your documents, pay the court’s fees, answer your questions, and jump through any hoops presented by the court. You’ll need to provide information about your divorce and sign/notarize a document called a Verification. In some counties that require a hearing before a judge, you will need to attend the hearing.

Requirements
  • Qualification for Divorce: The spouses have been living in separate homes for at least 12 months.
  • Jurisdiction: At least one spouse has been living in the same NC county for the last 6 months.
  • No Litigation: Neither spouse anticipates any disputes or needing any court orders.
  • Service of process: You know your spouse’s current address and they are not in prison or in military service.
When Recommended

Once a divorce decree is granted, many divorce-related legal claims are permanently closed. Simple divorce filings are ideal when the spouses have already signed a separation agreement or have been separated for 5+ years. In most cases, it is ideal to use a simple divorce filing only after divorce terms have been negotiated and finalized in a separation agreement.

What’s not Included

This only covers simple divorces that meet both the criteria of 50-10(e) and the requirements listed above throughout the divorce process. It does not include handling any disputes, counterclaims, service by publication, or other matters. It also does not include any in-person services, such as attendance at a hearing or in-person delivery of court documents. Some counties do require a judicial hearing, where you may need to attend yourself, pay an additional fee for King @ Law to attend for you, or make other arrangements.
